ALTERNATE DISPUTE RESOLUTION (ADR) FACILITATION SERVICES:

A critical decision in dispute resolution is selecting the most appropriate method to resolve the dispute in question. Depending on the facts of each case one needs to choose the most appropriate method. There are cases where litigation may be appropriate, in others arbitration and some cases are best mediated. This analysis and decision making requires thorough knowledge and experience in law and dispute resolution. We advise you to seek legal opinion prior to invoking any dispute resolution mechanism. Legal experts at CMA provide a free 30 minute consultation for case analysis and legal strategy with prior appointment.

CMA offers administration services, infrastructure and a panel of experts for mediation, arbitration, conciliation and facilitated negotiation. Once you have selected your preferred method of ADR, you may opt for all services from CMA or pick and choose a service as per your requirement. For example, we are happy to provide only administrative service if you wish to engage a neutral who is not empanelled with us, or you may want to conduct the proceeding at a location of your choice. It is possible to curate our services as per your requirement, convenience and budget.

TRAINING:

Consensual dispute resolution is in its nascent stage in India. For the longest time, we have believed that for getting justice we need to argue, connive and fight. If one follows what happens in court, it is clear that we have an overburdened, clogged litigation system leading to frustrated disputants. A lot of cases would be better managed through ADR. However, there is a lack of knowledge about ADR with the end users or ultimate beneficiaries. One way to address this problem is to talk about working with non-adversarial methods such as dialogue, negotiation and private adjudication to the prospective end user. This can be encouraged by providing training to more and more students, business houses, in-house counsels and general public about non-adversarial methods.

We take up trainings on negotiation, workplace mediation and strategic corporate dispute resolution to bridge this need.

AWARENESS, COMMUNITY MEDIATION AND LOK ADALATS:

CMA is a not for profit organization. Our primary aim is to create awareness about non-adversarial dispute resolution. We conduct free mediation camps, ADR awareness sessions for NGO’s and provide our services free of cost to local courts and Lok Adalats.
